Terms & Conditions of Use

Welcome to BERHUB. These Terms and Conditions govern the use of the BERHUB website, platform, applications, and related services (the "Platform"). By accessing or using BERHUB, you agree to be bound by these Terms and Conditions. If you do not agree, you must not use the Platform.

1. About BERHUB

BERHUB is an online marketplace that connects:

  • Domestic property owners;
  • Commercial property owners;
  • Property managers;
  • Landlords;
  • Estate agents and property representatives;

with independent SEAI-registered BER Assessors who wish to provide quotations and services relating to:

  • Building Energy Rating (BER) Certificates;
  • Non-Domestic Energy Assessments;
  • Energy-related compliance services.

BERHUB acts solely as a platform facilitating introductions and communication between users and assessors. BERHUB does not provide BER assessments, issue BER Certificates, or employ BER Assessors.

2. Acceptance of Terms

By using the Platform, you confirm that:

  • You are at least 18 years of age.
  • You have authority to act on behalf of the property owner where applicable.
  • Any information you provide is accurate and complete.
  • You will comply with all applicable laws and regulations.

3. User Accounts

Users may be required to create an account to access certain features. You are responsible for:

  • Maintaining the confidentiality of your login credentials.
  • All activities conducted under your account.
  • Updating account information to ensure it remains accurate.

BERHUB reserves the right to suspend or terminate accounts that contain false information or are used in breach of these Terms.

4. Property Requests

Property owners and managers may submit requests for BER services through the Platform. When submitting a request, you agree that:

  • All property details provided are accurate and complete.
  • You have authority to request the service.
  • The information submitted may be shared with registered BER Assessors for the purpose of preparing quotations.

BERHUB is not responsible for errors resulting from inaccurate information supplied by users.

5. Assessor Registration and Responsibilities

Assessors using BERHUB must:

  • Hold a valid SEAI registration.
  • Maintain all necessary professional qualifications and insurances.
  • Comply with SEAI regulations and applicable legislation.
  • Provide accurate information regarding qualifications, pricing, and availability.

Assessors are solely responsible for the services they provide and for maintaining compliance with professional and legal obligations. BERHUB may request evidence of registration or qualifications but does not guarantee the ongoing status of any assessor.

6. Quotations and Bidding Process

BERHUB allows registered assessors to submit quotations or bids for property assessment requests. Users acknowledge that:

  • Quotations are provided by independent assessors.
  • BERHUB does not verify the accuracy of quotations.
  • Prices may vary based on information provided and site conditions.
  • Assessors may revise quotations if property details differ materially from those originally submitted.

BERHUB does not guarantee that any request will receive quotations or that any assessor will be available for a particular project.

7. Independent Contractor Relationship

All BER Assessors using the Platform operate as independent businesses. Nothing contained within these Terms creates:

  • An employment relationship;
  • A partnership;
  • A joint venture;
  • An agency relationship;

between BERHUB and any assessor. Any contract for services is entered into directly between the property owner (or representative) and the selected assessor.

8. Payments

BERHUB may charge platform fees, administration charges, membership fees, lead fees, subscription fees, booking fees, or other service charges. Where applicable:

  • Fees payable to BERHUB relate solely to use of the Platform.
  • Payments to assessors for professional services are separate unless expressly stated otherwise.
  • All published fees may be amended from time to time.

Any payment disputes regarding assessment services must be resolved directly between the client and the assessor unless BERHUB specifically acts as a payment intermediary. Full details are set out in our Fees Policy.

9. Cancellations and Refunds

Refund eligibility shall be determined in accordance with BERHUB's Fees Policy. BERHUB reserves the right to refuse refunds where:

  • False information was provided by the user.
  • The assessor attended the property as agreed but could not complete the assessment due to circumstances outside their control.
  • The user cancelled the survey after the assessor surveyed the property.

Approved refunds will be processed to the original payment method where possible.

10. Quality of Services

BERHUB does not guarantee:

  • The quality of any assessor's work.
  • The accuracy of BER ratings.
  • The availability of assessors.
  • Completion times.
  • Pricing offered by assessors.
  • Acceptance of assessments by third parties.

Any concerns regarding services provided must be raised directly with the assessor responsible for the work.

11. Limitation of Liability

To the fullest extent permitted by law, BERHUB shall not be liable for:

  • Loss of profits;
  • Loss of revenue;
  • Loss of business opportunity;
  • Indirect or consequential losses;
  • Delays in service delivery;
  • Errors in assessments;
  • Inaccuracies in quotations;
  • Disputes between users and assessors.

BERHUB's total liability arising from use of the Platform shall not exceed the amount paid directly to BERHUB by the affected user within the preceding twelve months.

12. Assessor Liability

Assessors are solely responsible for:

  • Their professional advice;
  • Site inspections;
  • BER calculations;
  • Produced certificates;
  • Regulatory compliance;
  • Insurance obligations;
  • Tax obligations;
  • Contractual commitments.

Any claims arising out of assessment services shall be directed to the assessor who provided those services.

13. Intellectual Property

All content on the Platform, including logos, branding, software, databases, text, graphics, layouts, and designs, is owned by or licensed to BERHUB and protected by applicable intellectual property laws. Users may not copy, modify, distribute, or reproduce Platform content without prior written permission.

14. Reviews and Feedback

Users may provide reviews and ratings regarding assessors. By submitting reviews, users agree that:

  • Reviews are truthful and based on genuine experiences.
  • Reviews will not contain defamatory, abusive, unlawful, or misleading content.

BERHUB may remove reviews at its sole discretion.

15. Prohibited Activities

Users must not:

  • Provide false or misleading information.
  • Attempt to bypass Platform fees.
  • Harass or abuse other users.
  • Upload malicious software.
  • Interfere with the operation of the Platform.
  • Use automated tools to scrape or extract data.
  • Impersonate another person or organisation.

BERHUB may suspend or permanently terminate accounts involved in prohibited activities.

16. Privacy and Data Protection

BERHUB processes personal data in accordance with its Privacy Policy and applicable data protection laws, including the General Data Protection Regulation (GDPR). By using the Platform, you consent to the collection, use, and sharing of information necessary to facilitate quotations, bookings, and communications between users and assessors.

17. Communications

By registering with BERHUB, users agree to receive service-related communications, including:

  • Emails;
  • SMS / WhatsApp messages;
  • Platform notifications;
  • Telephone communications where appropriate.

Marketing communications will be provided only where consent has been obtained or otherwise permitted by law.

18. Suspension and Termination

BERHUB may suspend or terminate access to the Platform immediately where:

  • These Terms are breached;
  • Fraudulent activity is suspected;
  • False information is provided;
  • User behaviour creates legal or reputational risk.

Termination does not affect any rights or obligations arising before termination.

19. Changes to the Platform

BERHUB may modify, suspend, or discontinue any part of the Platform at any time without liability. Features, functionality, pricing structures, and service offerings may change from time to time.

20. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Ireland. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the Irish courts.
